Staff recommends approval with conditions. BACKGROUND: On June 10. 1999. the Governing Board of the District authorized a modification to SWM Permit No. 47-00227-S (Application No. 980213-6) for the Construction and Operation of a swm system to serve 1,197.5 acres of pasture known as 101 Ranch. The remaining contiguous ownership (1,217.5 acres). not included in that application. was to remain undeveloped. 1

.) The BACKGROUND section. included in the June 10. 1999 staff report. describes the recent 101 Ranch history as it pertains to the Fish Slough Basin. This application addresses 403 acres of the 1.217.5 acres described above. which is located at the northwest corner of 101 Ranch. LA 9----.., C)() 0 --~ ,, EXISTING FACILITIES: _,...,,/.,,.... 1 ,' 3 o ? ~ "9t 101 Ranch is located in northern Okeechobee Coun~y ---ximately four (4) miles north of Eagle Island Road (CR 724) direct west f 101 Ranch Road that forms the eastern boundary of Coquina Water Cont strict (refer to Exhibit No. 1). This 403 acres presently consists of pasture lands. The existing swm system consists of sheetflow to remnant collector ditches that convey runoff to Fish Slough to the east. PROPOSED FACILITIES: Proposed is an individual modification to SWM Permit No. 47-00227-S for the Construction and Operation of a swm system to serve 403 acres of agricultural lands discharging to Fish Slough. The swm system is proposed to consist of furrows and collector ditches that collect and convey excess stormwater runoff to a 10.8 acre minor above ground impoundment (reservoir) for water quality treatment andattenuation. Stormwater is pumped into the reservoir via 1-7.400 GPM pump with on and off elevations of 67.0' and 66.3' NGVD. respectively (refer to Typical Pump Layout shown on Exhibit No. 2). A single gravity control structure will be utilized to convey flows to Fish Slough. Proposed is 1-2.0' diameter drop inlet with a crest at elevation 71.0' NGVD. a 0.8' high by 0.9' wide rectangular bleeder with an invert at elevation 66.8' NGVD and 40 LF of 18" diameter CMP culvert (refer to Typical Bleeder & Discharge Structure detail on Exhibit No. 2). An emergency overflow consisting of 1-48" diameter drop inlet with a crest at elevation 69.5' NGVD will serve to direct excess stormwater within the reservoir back to the site to protect the integrity of the reservoir dike (refer to Typical Overflow & Return Structure shown on Exhibit No. 2). In addition. float switches within the reservoir (on: 68.8' NGVD and off: 69.8' NGVD) will also serve to limit stages within the reservoir and protect impoundment dikes. The perimeter elevation will be set to contain the design stage within the project boundaries. Exhibit No. 4 shows all existing culverts located within 101 Ranch. which includes all existing culvert crossings of Fish Slough within 101 Ranch. 2

WATER QUALITY: Water quality treatment for one (1) inch over the project site is being provided within a minor above ground impoundment (reservoir) prior to gravity discharge to the historic receiving system (Fish Slough). Turbidity and erosion control mechanisms will be utilized during construction to limit or prevent adverse off-site water quality impacts (refer to Exhibit No. 3). In addition, following completion of construction, the applicant shall vegetate berms/levees as necessary to maintain structural stability. Basin NORTHWEST BASIN Treatment Method 10.8 acres RESERVOIR IV. ENVIRONMENTAL ASSESSMENT PROJECT SITE DESCRIPTION: Vol Vol Req'd. Prov'd (ac-ft) (ac-ft) 34.00 34.00 The 403-acre watershed served by the proposed reservoir consists primarily of active pasture, with approximately 180 acres of depressional wetlands (see Exhibits 3 and 5). These wetlands are generally dominated by bullrush, with arrowhead, pickerelweed, and other herbaceous species . occurring in deeper portions of the wetlands. A portion of the wetlands and adjoining uplands within the project area are protected through provisions in the previous permit for 101 Ranch (Permit No. 47-00227-S). The applicant proposes construction of water management features to limit this site's direct discharge into Fish Slough. Proposed berms will limit direct sheetflow into Fish Slough, and a proposed reservoir around Wetland 5 will retain and control stormwater prior to discharging into Fish Slough (see Exhibits 2 and 3). The applicant will maintain a buffer of 25 feet and will use silt screens between the edge of Wetland 5 and construction activities associated with the proposed reservoir (see Special Condition 12 and Exhibits 2 and 3). No other changes to the existing surface water management system are proposed. 5

ENDANGERED, THREATENED & SPECIES OF SPECIAL CONCERN SUMMARY: The proposed construction to limit this site's discharge into Fish Slough is anticipated to improve drainage of the Audubon Preserve upstream of the project area. Improved drainage of the Preserve is anticipated to benefit the federally endangered grasshopper sparrow. which nests in dry prairie habitat in the Preserve. The project site also contains wetlands and pasture areas which provide foraging habitat for herons. wood storks. other wading birds. and caracara. The District anticipates that the proposed increased retention of water will improve the habitat values of this site. This permit does not relieve the applicant from complying with all applicable rules and any other agencies' requirements if in the future. endangered/threatened species or species of special concern are discovered on the site. LEGAL/INSTITUTIONAL: The applicant recorded a conservation easement over 95.05 acres of wetlands and uplands. shown on Exhibits 2 and 3. as required by the previous permit for 101 Ranch. WETLAND PRESERVATION AND IMPACT SUMMARY: The applicant will construct a reservoir incorporating Wetland 5 for the purposes of stormwater detention . Water will be pumped into the reservoir with a pump on elevation of 67.0' in the adjacent watershed. a pump off elevation of 66.3'. and a reservoir overflow at 69.5' NGVD. The pump will also have a float switch set to shut off if water levels in the reservoir exceed 69.8' NGVD. The applicant submitted flood routings demonstrating that operation of the reservoir will not overinundate the wetlan-0. The submitted routings show that the reservoir will bleed down from a maximum stage of 69. 8 feet to a stage of 67.3 feet (6 inches higher than control) in approximately 5 days. This reservoir is anticipated to improve the hydrology of this wetland. which has been the subject of past drainage. All other wetlands will remain in their current condition. due to no proposed changes in existing land use. The applicant will monitor and maintain all wetlands and uplands within the conservation easement. in accordance with Special Conditions 14 and 15 of the previous permit (Application No. 980213-6). The applicant proposes to construct a reservoir for a 403-acre agricultural watershed, incorporating a wetland into the reservoir. The reservoir control elevation is designed to improve the hydrology of the wetland. Other wetlands and water management features in the watershed are not proposed to be altered. Therefore, the District anticipates no adverse direct. secondary or cumulative impacts to wetland functions as a result of the proposed activity. SYSTEM OPERATION: Permittee PROPOSED LAND USE(S): Agricultural WATER USE PERMIT STATUS: A Water Use permit is not required for this project at this time. Any irrigation on this site will require a water use permit. DRI STATUS: This project is not a ORI. 7

SAVE OUR RIVERS: The project is not within or adjacent to lands under consideration by the Save Our Rivers program. SWIM BASIN: This site. 101 Ranch. was previously issued a Works of the District (WOO) Permit (No. 47-00239-Q) for improved pasture. Water quality monitoring within the basin indicates that this site is adhering to the established constituent limits described in the permit. In the event that monitoring indicates that constituent limits are being exceeded for this site. the applicant will be required to modify the permit (by submitting plans and calculations) to bring the site back into compliance with the established limits. RIGHT-OF-WAY PERMIT STATUS: A Right-of-Way Permit is not required for this project. ENFORCEMENT ACTIVITY: There has been no enforcement activity associated with this application. THIRD PARTY INTEREST: No third party has contacted the District with concerns about this application. WELL FIELD ZONE OF INFLUENCE: The project is not located within the zone of influence of a wellfield. 8 ' .
